UniPin will maintain separate, clearly accessible website pages for the Website Terms and Conditions, User Terms or Product Terms, Privacy Policy, Refund and Cancellation Policy, Delivery Policy for Digital Goods, Contact Us or Customer Support, and Complaints or Illegal Activity Reporting. These pages are intended to support global e-commerce, payment partner and card association expectations for transparency and user protection.

These User Terms and Conditions (“User Terms”) govern your registration, account access, purchase, redemption and use of UniPin Credits, UniPin Voucher, UP Points digital game top-ups, digital credits, soft pin vouchers, game vouchers and any other digital products made available by UniPin from time to time (“UniPin Products”) through UniPin’s website located at www.unipin.com, mobile application and/or any other portal made available by UniPin or its affiliates from time to time (collectively, the “Platform”).

The Platform is developed and maintained by MOBILE ARTS SDN. BHD. Unless expressly stated otherwise at the point of purchase, the relevant UniPin entity processing or fulfilling the transaction shall be the seller or service provider for the applicable UniPin Products.

By accessing or using the Platform, creating an account, making a purchase, redeeming any UniPin Products, or otherwise using any services provided by UniPin, you acknowledge that you have read, understood and agree to be legally bound by these User Terms.

For the purposes of these User Terms, “UniPin”, “we”, “us” and “our” refer to UniPin and/or the relevant UniPin entity operating the Platform or providing the applicable UniPin Products, as the context requires.

Unless otherwise stated at the point of purchase, order confirmation, receipt or other transaction record, the relevant UniPin entity processing, fulfilling or issuing the transaction confirmation for the applicable UniPin Products shall be the seller or service provider for that transaction.

We may amend these User Terms at any time by posting the amended User Terms on the Platform. Any amendments shall take effect upon posting, unless otherwise stated. Your continued  access to or use of the Platform, or continued purchase, redemption or  use of UniPin Products, after such amendments are posted constitutes your acceptance of the amended User Terms.

1. UniPin reserves the right to refuse to provide the UniPin Products to anyone for any reason at any time. Your use of UniPin Products and/or Platform is at your sole risk. In circumstances where you are authorised both to make purchases for the organisation, you may make purchases using a corporate or business mobile account or payment instrument and shall agree to these User Terms on its behalf.
2. You expressly understand and agree that UniPin shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, or damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use UniPin Products and/or Platform.
3. In no event shall UniPin or our merchants be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our Platform, UniPin Products or these User Terms (however arising including negligence). You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys´ fees, made by any third party due to or arising out of your breach of these User Terms or the documents it incorporates by reference, or your violation of any law or the rights of a third party or your use of UniPin Products and/or our Platform.
4. UniPin Products may provide, or third parties may provide, links to other World Wide Web (www) sites or resources. Because UniPin has no control over such websites and resources, you acknowledge and accept that UniPin is not responsible for the availability of such external websites or resources, and do not endorse and is not responsible or liable for any information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), advertising, products or other materials on or available from such websites or resources. As such, you also acknowledge and accept that UniPin does not and is not obligated to examine, evaluate or screen any of these external resources and does not warrant or endorse any of the information, content, offers or claims of these third parties. You further acknowledge and agree that UniPin shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods available on or through any such website or resource.
5. You agree not to alter, modify, reproduce, duplicate, copy, sell, resell or exploit any portion of UniPin Products, use of, or access to UniPin Products without the express written permission by UniPin.
6. The entire content of this Platform which consists of inter alia text, video (of any format, streaming or otherwise), audio clips (of any format, streaming or otherwise), data assemblages, graphics, logos, buttons, icons and any software (the "Site Content") is proprietary to UniPin or its content provider or other third parties and is protected under international and domestic copyright laws. The arrangement and/or compilation of the Site Content is proprietary to UniPin and is protected under international and domestic copyright laws.
7. Verbal or written abuse of any kind (including but not limited to threats of abuse or retribution and defamatory statements) of any UniPin’s customer, employee, member, or officer will result in immediate account termination.
8. The failure of UniPin to exercise or enforce any right or provision of these User Terms shall not constitute a waiver of such right or provision.
9. Using UniPin Products, you agree that:
   1. transactions made via UniPin are generally final once initiated, processed, delivered, credited, redeemed, used, activated or otherwise made available, subject always to the Refunds, Cancellations and Statutory Consumer Rights section and any mandatory consumer protection rights, statutory guarantees, legal warranties, refund rights, cancellation rights or other non-excludable remedies available under applicable law.
   2. Before payment is completed, UniPin will display the product description, price, currency, applicable taxes or fees, merchant or seller identity where required, payment method, delivery method, refund and cancellation rules, and the billing descriptor that may appear on the user’s card or payment statement. Users should check the product, game, server, platform, account details, region, quantity, amount and currency carefully before confirming payment. UniPin Products are digital products and purchases are generally final once successfully delivered, credited, redeemed, used, activated or otherwise made available, except where a refund, cancellation, correction, replacement, re-credit, reversal or other remedy is required by applicable law or approved by UniPin in accordance with these User Terms. Nothing in the checkout notice limits any mandatory consumer protection rights or statutory guarantees that may apply to the user. UniPin will provide an electronic receipt or confirmation by email, SMS, in-app message or account notification after successful purchase.
   3. you are solely responsible in the usage of your mobile account or payment channel and that UniPin shall have no liability to you or any third party for any unauthorised use or access of UniPin through your mobile account or payment channels or in the event your mobile account or your account has been compromised. In such circumstances, it is your responsibility to inform your mobile operator or your payment channel of such instances.
   4. any taxes, duties, currency exchange fees, data charges and any other applicable charges in relation to your purchases via UniPin shall be borne by you.
   5. UniPin, or your mobile operator if made purchase via your mobile account or your chosen payment channel provided at unipin.com has the sole discretion to accept or decline a transaction performed by you through UniPin for whatsoever reason, and that, should this occur, UniPin shall not be held liable to you.
   6. you have consented to be contacted by UniPin, and to receive notices electronically, including but not limited to by text message, from us. You agree that we may make any notices that we may be required by law to make in electronic format. These communications will be deemed to be in writing and received by you when sent to you.
   7. you may be required to register with the Platform. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
10. As a user of UniPin Products, you agree not to:
    1. use UniPin Products in any way that violates any applicable law or for any unlawful purpose.
    2. disparage, tarnish, or otherwise harm, UniPin, our Platform, or UniPin Products.
    3. make any unauthorised use or access of UniPin Products, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user account by automated means or under false pretences.
    4. use a buying agent or purchasing agent to make purchases using UniPin Products and thereafter charge other directly or indirectly for such uses.
    5. attempt to impersonate another user or person or use the username of another user.
    6. use any information obtained from the Platform in order to harass, abuse, or harm another person.
    7. systematically retrieve data or other content from the Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
    8. circumvent, disable, or otherwise interfere with security-related features of the Platform, including features that prevent or restrict the use or copying of any content or enforce limitations on the use of the Platform and/or the content contained therein.
    9. engage in unauthorised framing of or linking to the Platform / UniPin Products.
    10. trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords;
    11. make improper use of our support services or submit false reports of abuse or misconduct.
    12. engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
    13. interfere with, disrupt, or create an undue burden on the Platform or the networks or UniPin Products connected to the Platform.
    14. decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Platform.
    15. attempt to bypass any measures of the Platform designed to prevent or restrict access to the Platform, or any portion of the Platform.
    16. harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of UniPin Products to you.
11. UniPin reserves the right to deny payments from suspicious buyers. In the event that an order or payment is tagged as being suspicious, delivery of item(s) will be delayed until UniPin can successfully verify its legitimacy, be it by phone or a request for verifying information. The determination of what amounts to suspiciousness shall be at the sole and absolute discretion of UniPin. You acknowledge and accept that under the laws of certain jurisdiction, UniPin may be obligated to report any suspicious transactions to the relevant authorities.
12. Unless you notify UniPin of a delivery, redemption or product issue within a reasonable time after becoming aware of the issue, and subject to the Refunds, Cancellations and Statutory Consumer Rights section and applicable law, UniPin Products that have been successfully delivered, credited, redeemed, used, activated or otherwise made available will be treated as accepted by you. This does not affect any mandatory consumer protection rights, statutory guarantees, legal warranties or remedies that cannot lawfully be excluded, restricted or modified under applicable law.
    1. UniPin Products are generally delivered digitally through instant account crediting, voucher code, PIN, soft pin, email, SMS, in-app confirmation or publisher account fulfilment. Delivery time may vary depending on payment verification, publisher system availability, fraud review, user information accuracy, network conditions and compliance checks. Users must ensure that game ID, server, region, account and payment details are accurate before confirming purchase.
13. Payment, Purchase and Transaction Terms
    1. You undertake to make all payments promptly and in accordance with any rules, regulations or guidelines issued by UniPin from time to time, and shall not be entitled to withhold payment of all or any part of the price.
    2. All purchases made through UniPin’s Platform relate solely to digital game top-ups, digital credits, UniPin Credits, soft pin vouchers, game vouchers or other digital products made available on the Platform. Such purchases do not constitute the purchase of any physical goods, tangible products, or proprietary licence to any software or service.
    3. Users are responsible for verifying all account identifiers, server details, platform information, product selection, purchase details and redemption details before confirming a transaction. UniPin shall not be liable for any loss, failed delivery, incorrect delivery, non-redemption or misuse arising from incorrect, incomplete or inaccurate details provided by the user, unauthorised use of the user’s Account or Payment Channel, or the user’s failure to comply with applicable redemption instructions, except where otherwise required by applicable law.
    4. Any request for a refund, cancellation, correction, replacement, re-credit, reversal or other remedy shall be handled in accordance with the Refunds, Cancellations and Statutory Consumer Rights section and any mandatory consumer protection rights, statutory guarantees, legal warranties or other non-excludable rights available to the user under applicable law.
    5. UniPin may provide purchase-specific notices on the checkout page, order confirmation page, email receipt or other transaction communication. Such notices are intended to supplement these User Terms and remind users of the applicable purchase, redemption, refund and privacy terms.
    6. Personal Information collected in connection with a transaction will be processed in accordance with UniPin’s Privacy Policy. Users, including California residents where applicable, should refer to the Privacy Policy for further information on their privacy rights and how to exercise them.
14. Digital Delivery and Fulfilment
    1. UniPin Products are digital products and are delivered electronically through the Platform. Delivery may be completed by crediting the relevant game account, displaying or sending a voucher code, making the digital product available in the user’s Account, or through any other electronic fulfilment method stated at checkout, on the order confirmation page, or in the applicable product-specific terms.
    2. Delivery is generally processed after successful payment confirmation, subject to Payment Channel processing, fraud screening, publisher or platform availability, system availability, and any additional verification required by UniPin. UniPin does not provide physical delivery or shipment of UniPin Products unless expressly stated otherwise. Any delay, failure, correction, replacement, re-credit or other remedy relating to digital delivery shall be assessed in accordance with the Refunds, Cancellations and Statutory Consumer Rights section and applicable law.
    3. Delivery of UniPin Products will be made based on the account identifiers, server details, platform information, product selection, purchase details and redemption details submitted by the user at the time of transaction. Subject to the Refunds, Cancellations and Statutory Consumer Rights section and except where otherwise required by applicable law, UniPin shall not be liable for any failed delivery, incorrect delivery, delayed delivery, non-redemption or loss arising from inaccurate, incomplete or incorrect details provided by the user.
    4. Nothing in this Digital Delivery and Fulfilment section excludes, restricts or modifies any mandatory consumer protection rights, statutory guarantees, legal warranties, refund rights or other remedies that cannot lawfully be excluded, restricted or modified under applicable law. Where UniPin Products are faulty, defective, not as described, not supplied as agreed, incorrectly delivered due to UniPin’s fault, not delivered, or otherwise fail to comply with applicable consumer guarantees or statutory standards, UniPin will provide the remedy required by applicable law.
15. Refunds, Cancellations and Statutory Consumer Rights
    1. Unless otherwise required by applicable law, all purchases of UniPin Products are final once the relevant UniPin Product has been successfully delivered, credited, redeemed, used, activated, transferred, or made available to the user or to the relevant recipient account, game account, wallet, platform account, mobile number or other destination selected by the user.
    2. UniPin does not generally provide refunds, cancellations, reversals, exchanges, transfers or cash redemptions for completed transactions where the UniPin Product has been correctly supplied in accordance with the user’s order. This includes situations where the user has changed their mind, selected the wrong product, entered incorrect account details, entered incorrect server details, entered incorrect platform information, failed to redeem the product within the applicable validity period, no longer requires the product, or purchased a product that is incompatible with the user’s intended account, device, platform, game, region or service.
    3. Nothing in these User Terms excludes, restricts or modifies any mandatory consumer protection rights, statutory guarantees, legal warranties, refund rights, cancellation rights or other remedies that cannot lawfully be excluded, restricted or modified under applicable law, including any rights available to consumers in the European Union, United Kingdom, Australia, New Zealand, the United States or any other applicable jurisdiction.
    4. Where applicable law gives a user mandatory rights in relation to digital content, digital services, goods or services that are faulty, defective, not as described, not supplied with reasonable care and skill, not fit for purpose, not delivered, incorrectly delivered due to UniPin’s fault, or otherwise fail to comply with applicable consumer guarantees or statutory standards, UniPin will provide the remedy required by applicable law. Depending on the circumstances and the applicable law, this may include correction, re-performance, replacement, re-crediting, price reduction, refund, cancellation or another legally required remedy.
    5. For users in the European Union or United Kingdom, where applicable consumer laws grant rights in respect of faulty digital content or digital services, those rights shall continue to apply notwithstanding any statement that purchases are final once delivered, redeemed, used or activated. Where the user expressly consents to the immediate supply of digital content or digital services and acknowledges that any applicable cooling-off withdrawal right may be lost once supply begins, this shall not affect the user’s statutory rights where the digital content or digital service is faulty, not as described, not supplied as agreed, or otherwise fails to meet applicable legal standards.
    6. For users in Australia, UniPin Products and services may come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these User Terms is intended to limit or exclude any rights a user may have under the Australian Consumer Law, including rights to a repair, replacement, refund, cancellation or other remedy where there is a failure to comply with a consumer guarantee.
    7. To request a refund, cancellation, correction, replacement, re-credit, reversal or other remedy, the user must contact UniPin customer support within a reasonable time after becoming aware of the issue and provide the relevant transaction details, including the order number, payment receipt, account details, product details, error message, screenshots where applicable, and any other information reasonably required by UniPin for verification.
    8. UniPin may require reasonable time to investigate the transaction, including verification with game publishers, content partners, payment partners, payment channels, distributors, telecommunications providers, fraud monitoring systems, technical service providers or other relevant third parties. UniPin may refuse a refund or other requested remedy where the transaction was correctly processed and delivered in accordance with the user’s instructions, where the issue was caused by incorrect or incomplete information provided by the user, where the product has been successfully redeemed or consumed, where the request is fraudulent, abusive or inconsistent with these User Terms, or where UniPin is not legally required to provide the requested remedy. However, this does not affect any mandatory rights or remedies that the user may have under applicable law.
    9. Where a refund is approved, UniPin may process the refund through the original payment method, UniPin Credits, store credit, reversal, re-crediting or any other method permitted by applicable law and operationally available for the relevant transaction. The timing of any refund may depend on the relevant payment provider, bank, card scheme, telecommunications provider, payment channel or other third-party processor.
16. Customer Support, Complaints And Transaction Enquiries
    1. If you have any questions, complaints or support requests relating to your Account, purchase, payment, delivery, redemption, refund request, unauthorised transaction, suspected fraud, misuse, illegal activity or use of UniPin Products, please contact UniPin through our customer support portal or at [email protected].
    2. Users may report suspected illegal activity, fraud, misuse, unauthorised transactions, prohibited content or abuse of the Platform through UniPin’s customer support portal or at [email protected]. UniPin will review reports, may request supporting information, and may take appropriate action, including suspending transactions, restricting accounts, removing content, escalating to the relevant Payment Channel, Payment Service Provider, Game Publisher, Content Partner, authority or law enforcement agency, or taking other remediation steps where required by applicable law or UniPin’s internal compliance policies.
    3. UniPin may request supporting information to review your request, including your transaction ID, order confirmation, payment details, account details, voucher code, screenshots or other relevant information. UniPin may take appropriate action where necessary, including reviewing the transaction, suspending or restricting an Account, cancelling or delaying a transaction, escalating the matter to the relevant Payment Channel, Payment Service Provider, Game Publisher, Content Partner, authority or law enforcement agency, or taking other remediation steps where required by applicable law or UniPin’s internal compliance policies.
    4. For privacy-related questions, requests or complaints, including requests to exercise your privacy rights, please refer to UniPin’s Privacy Policy or contact UniPin through the privacy contact details stated in the Privacy Policy.
17. UniPin Products and Reward Program
    1. UniPin Credits are not legal tender. They are virtual credits which allow users to reload and spend on any online and mobile games available at unipin.com and UniPin Content Partners’ payment platforms.
    2. UniPin Voucher is a game voucher which carries UniPin Credits in the form of a physical voucher or soft pin. Each UniPin Voucher comprises of a unique serial number and pin code which allow users to reload UniPin Credits into their UniPin account or perform flash top up into games which are available at unipin.com and UniPin Content Partners’ payment platforms.
    3. UP Points means UniPin Points, a stored value balance made available by UniPin and recorded electronically in your Account.
    4. UniPin Reward Program Membership (“Program”) Under the Program, users who register and are accepted as UniPin Reward members may be entitled to collect reward points known as “Reward Points” through the purchase of UniPin Credits on the Platform. Reward Points collected by UniPin Reward members may be used to redeem UniPin Credits, merchandise, gift certificates and other reward (“Rewards”) provided by UniPin, its affiliates, suppliers, manufacturers, retailers, content providers or other partners (“Partners”), as offered by UniPin from time to time.
    5. Program Terms. Registration, membership, collection of Reward Points, redemption of Rewards and all benefits under the Program are subject to these User Terms and any Program-specific terms, rules or guidelines made available by UniPin from time to time.
       1. By registering for the Program, collecting Reward Points, redeeming Rewards otherwise participating in the Program, you acknowledge that you have read, understood and agree to be bound by these User Terms and any applicable Program-specific terms, rules or guidelines, as may be updated from time to time.
       2. Rewards, Reward Points, credits or benefits are promotional only, have no cash value, are not e-money, are not deposits, are not legal tender, and cannot be withdrawn, transferred, sold, exchanged for cash or used outside authorised UniPin channels, unless expressly permitted by UniPin in writing and subject to applicable law.
       3. These User Terms govern your participation in the Program, including your right to collect, use and redeem Reward Points, redeem Rewards, and receive any other benefits under the Program.
       4. Personal Information collected in connection with the Program will be processed in accordance with UniPin’s Privacy Policy, which is available separately on the Platform.
       5. Where your participation in the Program is carried out online or through electronic communications, you agree that your registration, acceptance of these User Terms, participation in the Program and related transactions may be formed and evidenced electronically.
       6. To the fullest extent permitted by applicable law, UniPin shall have the right to interpret and determine matters relating to the Program, Reward Points, Rewards and Program benefits, including eligibility, earning, redemption, adjustment, cancellation or forfeiture of Reward Points or Rewards.
18. Participation in the Program
    1. UniPin membership only applies to individuals, not to companies, organisations or any other body.
    2. To register in the Program, you must (i) register or sign up to acquire a UniPin account (“Account”), and (ii) be at least eighteen (18) years old and if you are under the age of 18 (or equivalent minimum age in the relevant jurisdiction), we require you to obtain permission from your legal guardian to register for an account and that the legal guardian must agree to these User Terms. If you are the legal guardian of a minor who is registering for an Account, you must accept these User Terms on the minor’s behalf and you will be responsible for all use of the Account, including any transactions made by the minor, whether the minor’s account is now open or created later and whether or not the minor is supervised by you during his or her use of UniPin Products.
    3. If we accept your registration application, we will sign you up in the Program as a UniPin Reward Program member (“Member”), you must provide any change to your Personal Information to us, such as name, mailing address, email address, and phone number by contacting our Customer Support at [email protected] or you may renew your Personal Information through www.unipin.com (“Member Web Portal“).
    4. If your account is lost and you forgot Your email and access code, you will lose all of your Reward Points.
    5. UniPin reserves the right to terminate your membership at any time for whatsoever reason UniPin deem fit.
19. PIN (Personal Identification Number) and Account Security
    1. Email is required to access the Member Account and to redeem your Reward Points, or when contacting Customer Support at [email protected]
    2. You are responsible for ensuring that you keep your email confidential at all times and to notify us over any illegal use of your email or when your email is compromised.
    3. We are not responsible or accountable in any way over losses arising from our failure to fulfil these conditions.
20. Reward Points Acquisition
    1. Reward Points is acquired for every purchase of UniPin Credits made by using the payment channels provided at unipin.com.
    2. To acquire Reward Points you must perform a transaction purchase at www.unipin.com
    3. Reward Points will then be automatically added to your UniPin membership Account no later than 24 hours after the transaction has been initiated.
    4. Users will only acquire Reward Points for eligible transactions, namely where the user purchases UniPin Credits or redeems UniPin Voucher for UniPin Credits on the Platform. Reward Points will be calculated based on the applicable eligible transaction value at the rate, eligibility criteria and country or region availability determined by UniPin from time to time and made available on the Platform, Reward Program page, campaign terms, product page or other applicable notice.
    5. Reward Points will not be awarded for failed, cancelled, refunded, reversed, fraudulent, disputed or chargeback transactions, or any other transaction that UniPin determines to be ineligible. UniPin reserves the right to change the Reward Points earning rate, eligibility criteria, applicable countries or regions, calculation method and related provisions at any time, subject to applicable law.
21. Reward Points Expiration
    1. Reward Points expires twelve (12) months after the date it is acquired.
22. Reward Points Usage
    1. Reward Points does not have any cash value, monetary value, or other values, and cannot be converted to any currency. Reward Points is calculated according to the Reward Program that we provide from time to time. UniPin reserves the right to set the amount of Reward Points required to redeem or convert into any goods or benefits that will be exchanged and to alter the amount at any time, without prior notice.
23. Intellectual Property Rights
    1. If you purchase any digital content from the Platform, it is exclusively for your personal consumption. You have no right to reproduce it for any reason. Except for the licenses granted in these User Terms, you have no right, title or interest in or to UniPin or UniPin Products. The content and information of this Platform is protected by intellectual property rights law and owned by UniPin and/or the proprietary property of its suppliers, affiliates, or licensors. Without UniPin’s prior written permission, you may not copy, reproduce, publish, distribute, transmit, display, license, sell, circulate, create derivative works from, or otherwise exploit the content and information of this Platform to any third party (including, without limitation, the display and distribution of the material via a third party websites or other networked computer environment).
    2. Unauthorised use of this Platform, including without limitation, unauthorised entry into the UniPin systems, misuse of passwords or misuse of any information posted on the Platform is strictly prohibited. In addition, use of this Platform is unauthorised in any jurisdiction where the use of this Platform may violate any applicable legal requirements.
    3. All trademarks, product marks, trade names, logos and icons (collectively "Trademarks") displayed on our Platform are registered and unregistered Trademarks of UniPin and others. Nothing contained in our Platform should be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any Trademark displayed on our Platform without the written permission of UniPin or such third party that may own the Trademarks displayed on our Platform. Your use of the Trademarks displayed on our Platform, or any other content on our Platform, is strictly prohibited.
24. Disclaimer Of Warranties
    1. For consumers in other jurisdiction with mandatory consumer protections, these disclaimers apply only to the fullest extent permitted by law and do not limit statutory rights relating to digital content quality, fraud, unauthorised payments, refunds, unfair terms, negligence, wilful misconduct or other rights that cannot lawfully be excluded.
    2. UNIPIN DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE UNIPIN PRODUCTS AND/OR PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT FROM TIME TO TIME WE MAY REMOVE THE UNIPIN PRODUCTS FOR INDEFINITE PERIODS OF TIME, OR CANCEL THE UNIPIN PRODUCTS IN ACCORDANCE WITH THESE USER TERMS.
    3. UniPin may rely on Game Publishers, Content Partners, Payment Channels, Payment Service Providers and other third parties for product availability, fulfilment, redemption, payment processing and related support. To the fullest extent permitted by applicable law, UniPin is not responsible for issues caused solely by third-party systems, publisher platform outages, user error, incorrect user information or circumstances outside UniPin’s reasonable control. However, nothing in this section excludes, restricts or modifies any mandatory consumer protection rights, statutory guarantees, legal warranties, refund rights, payment reversal rights or other remedies that cannot lawfully be excluded, restricted or modified under applicable law.
    4. Because UniPin Products are digital goods that may be delivered or made available immediately, purchases are generally final once successfully processed, delivered, credited, redeemed, used or activated. Any refund, cancellation, correction, replacement, re-credit, reversal or other remedy shall be handled in accordance with the Refunds, Cancellations and Statutory Consumer Rights section. UniPin may provide a remedy where required by applicable law, where UniPin has charged in error, failed to deliver the purchased item, delivered the wrong item due to UniPin’s fault, or where a valid unauthorised transaction, fraud, duplicate charge or payment network rule requires reversal or refund. Users must submit refund or cancellation requests through UniPin customer support with order ID, payment details and supporting evidence within the period stated on the Refund and Cancellation Policy page, where applicable.
    5. We have the absolute discretion to alter these User Terms, in any way in respect of the Program, including terms of ordering, Reward Points redemption procedures for Reward, or Reward in any form, without prior notice, and even if the changes can affect the value of the accumulated Reward Points. You must check our present User Terms and details and other information for the Program through the Member Web Portal or by calling our Customer Support at [email protected].
    6. Our Platform content are provided based on “as is” and “as available”. We hereby firmly state that we do not make any guarantees or collaterals whether expressly or implicitly, in respect to the merchantability of a product or suitability of UniPin Products that we provide for a specific purpose.
    7. From time to time, UniPin Products may be delayed, interrupted or disrupted for an indeterminate period of time. In addition, except as otherwise required by applicable law or regulation, UniPin may terminate your use of UniPin Products or impose limits on the type and/or amount of transactions you are allowed to make with UniPin Products at any time at its sole discretion without prior notice. UniPin and its affiliates shall not be liable for any claim arising from or related to UniPin arising from any such delay, interruption, disruption, limitation, or suspension.
    8. This disclaimer is subject to change to reflect regulatory updates or operational adjustments. Continued use of our services constitutes acceptance of the latest version.
25. Limitation Of Liability
    1. YOU EXPRESSLY UNDERSTAND AND AGREE THAT TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES (AND OUR AND THEIR RESPECTIVE EMPLOYEES, DIRECTORS, AGENTS AND REPRESENTATIVES), PARTNERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS OR SERVICES, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH: (i) THE USE OR INABILITY TO USE THE UNIPIN PRODUCTS AND/OR  PLATFORM; (ii) ANY CHANGES MADE TO THE UNIPIN PRODUCTS AND/OR  PLATFORM OR ANY TEMPORARY OR PERMANENT CESSATION OF THE UNIPIN PRODUCTS AND/OR  PLATFORM OR ANY PART THEREOF; (iii) THE UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE AND/OR SEND OR RECEIVE YOUR TRANSMISSIONS OR DATA ON OR THROUGH THE UNIPIN PRODUCTS AND/OR  PLATFORM; (v) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE UNIPIN PRODUCTS AND/OR  PLATFORM; (vi) PROGRAM OR YOUR PARTICIPATION IN THE PROGRAM, (vii) DELAY, FAILURE OR DECISION BY US IN THE OPERATION OF THE PROGRAM OR ANY CHANGES TO THESE USER TERMS ON THE REDEMPTION AND USAGE OF THE POINTS (viii) ILLEGITIMATE USE OF YOUR MEMBER CARD OR PIN, (ix) OFFERS, DESCRIPTION, STATEMENTS OR CLAIMS ABOUT THE PROGRAM, BRANDS OR PARTNERSHIP OR ANY INDIVIDUAL, (x) PURCHASES, REDEMPTIONS OR USAGE OF GOODS FROM THE BRAND OR PARTNERSHIP, INCLUDING OTHER REWARD, WHETHER PROVIDED BY US OR ONE OF OUR AFFILIATES, BRAND OR PARTNER. OUR BRAND AND PARTNERS ARE NOT ACCOUNTABLE FOR THE PROGRAM AND (xi) ANY OTHER MATTER RELATING TO THE UNIPIN PRODUCTS AND/OR PLATFORM.
    2. TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE AGGREGATE LIABILITY OF UNIPIN OR OUR AFFILIATES (AND OUR AND THEIR RESPECTIVE EMPLOYEES, DIRECTORS, AGENTS AND REPRESENTATIVES), PARTNERS AND LICENSORS ARISING OUT OF OR IN CONNECTION WITH THESE USER TERMS OR THE TRANSACTIONS CONTEMPLATED HEREBY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE, PRODUCT LIABILITY OR OTHER THEORY), WARRANTY, OR OTHERWISE, EXCEED THE AMOUNT OF FEES PAID BY YOU TO UNIPIN IN CONNECTION WITH YOUR USE OF UNIPIN PRODUCTS AND/OR PLATFORM DURING THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM FOR LIABILITY.
    3. Nothing in these User Terms excludes, restricts or limits any liability, warranty, guarantee, refund right, statutory remedy, consumer protection right or other right that cannot lawfully be excluded, restricted or limited under applicable law.
26. Termination
    1. UniPin may at any time, under certain circumstances and without prior notice, immediately terminate or suspend all or a portion of your Account and/or access to UniPin Products. Cause for such termination shall include:

1. violations of these User Terms or any other policies or guidelines that are referenced herein and/or posted on UniPin Products;
2. a request by you to cancel or terminate your Account;
3. a request and/or order from law enforcement, a judicial body, or other government agency;
4. where provision of UniPin Products to you is or may become unlawful;
5. unexpected technical or security issues or problems;
6. your participation in fraudulent or illegal activities; or
7. failure to pay any fees owed by you in relation to UniPin Products, provided that in the case of non-material breach, UniPin will be permitted to terminate only after giving you 30 days’ notice and only if you have not cured the breach within such 30-day period. Any such termination or suspension shall be made by UniPin in its sole discretion and UniPin will not be responsible to you or any third party for any damages that may result or arise out of such termination or suspension of your Account and/or access to UniPin Products.
   1. UniPin will maintain a complaints process for users to report payment issues, account access issues, delivery failures, suspected fraud, illegal activity, unlawful content, harmful activity, privacy concerns and consumer complaints. UniPin may review, investigate, request supporting information, escalate to publishers, payment partners or regulators, restrict access or remediate where appropriate. Complaint channels, expected response times and escalation routes will be displayed on the Contact Us or Help Centre page where applicable.
   2. In addition, UniPin may terminate your Account upon 30 days’ prior notice via email to the address associated with your Account if (a) your Account has been inactive for one (1) year; or (b) there is a general discontinuance of UniPin Products or any part thereof. Notice of general discontinuance of UniPin Products will be provided as set forth herein, unless it would not be reasonable to do so due to circumstances arising from legal, regulatory, or governmental action; to address user security, user privacy, or technical integrity concerns; to avoid disruptions to other users; or due to a natural disaster, a catastrophic event, war, or other similar occurrence outside of UniPin’s reasonable control.
   3. Should you breach any of these User Terms, UniPin shall have the exclusive sole and absolute right to terminate, discontinue or withdraw the provision of UniPin Products to you. In the event of a breach by you, UniPin reserves its right to pursue any remedy or relief in so far as permitted by law, which includes but is not limited to injunction, damages and/or specific performance.

2. Miscellaneous
   1. UniPin is not a bank, e-money issuer, or money transferor and does not require the approval of the relevant Authorities to operate. Your prepaid or post-paid mobile account is not a bank account, e-money account, payment card, or other regulated financial instrument. UniPin does not process or store your full credit or debit card number. UniPin may process payment-related information, such as payment method, payment channel, transaction details, payment status, masked card details, payment identifiers or other information required to process the transaction. Full credit or debit card numbers and card expiry details may be collected and processed directly by the relevant Payment Channel or Payment Service Provider, where applicable.
   2. Where card payments, Automated Clearing House (ACH), wallets, carrier billing or other payment methods are supported, UniPin may be required to comply with applicable payment network rules, PCI DSS, anti-fraud controls, chargeback rules, authentication requirements, reserve or settlement rules, KYC/KYB requirements and payment partner policies. Users agree that payment approval may be subject to third-party payment partner review and that UniPin may decline, hold, reverse or verify transactions for risk or compliance reasons.
   3. These User Terms shall be governed by and construed according to the laws of Malaysia, without regard to its conflicts-of-law principles, and you and UniPin agree to submit to the exclusive jurisdiction of the Malaysia courts. Nothing in these User Terms limits any mandatory consumer protection, privacy, data protection or other statutory rights that cannot be excluded under applicable law.
   4. For UK users, mandatory rights under UK consumer protection, digital content, unfair terms, privacy and online safety laws may apply. These User Terms must be read subject to such non-excludable rights.
   5. Nothing in these User Terms is intended to, or shall be deemed to, create any joint venture, employment, creditor-debtor, escrow, partnership, agency, trust or fiduciary relationship between you and UniPin, or between you and any UniPin affiliate. UniPin may assign or transfer these User Terms, and any of its rights or obligations under these User Terms, in whole or in part, to any affiliate, successor, purchaser or third party, with or without notice to you, where permitted by applicable law. You may not assign or transfer these User Terms, or any of your rights or obligations under these User Terms, to any other party without UniPin’s prior written approval. Any attempted assignment or transfer by you without such approval shall be void.
   6. Notwithstanding any law, rule or regulation to the contrary, you agree that any claim or cause of action you may have arising out of these User Terms must be filed within one (1) year after such claim or cause of action first could be filed or be forever barred. We will not be considered to have waived any of our rights or remedies, or portion of them, unless the waiver is in writing and signed by us. Our failure to enforce the strict performance of any provision of these User Terms will not constitute a waiver of our right to subsequently enforce such provision or any other provisions.
   7. These User Terms constitute the entire agreement between you and UniPin, and supersede and cancel all prior and contemporaneous agreements, claims, representations, and understandings (including, but not limited to, any prior versions of the User Terms). No modification or amendment of these User Terms will be binding on UniPin unless set forth in writing and signed by UniPin.
   8. If any part of these User Terms is held by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions will remain in full force and effect. If possible, any invalid or unenforceable provision shall be construed in a manner that most closely reflects the original intent and purpose of such provision. If such construction is not possible, the invalid or unenforceable provision shall be deemed severed from these User Terms, and the remaining provisions shall continue in full force and effect.
   9. These User Terms were written in English. To the extent any translated version of these User Terms conflicts with the English version, the English version controls and prevails. We reserve the right to change, modify or otherwise alter these User Terms at any time. You can find the most recent version on our Platform. Such modifications shall become effective immediately upon the posting thereof.
